A. Authority. These rules and regulations are promulgated under the authority of Chapters 70.05, Local Health Departments, Boards, Officers–Regulations; and 70.95, Solid Waste Management–Reduction and Recycling, in the Revised Code of Washington (RCW); Chapters 173-350, Solid Waste Handling Standards; 173-351, Criteria for Municipal Solid Waste Landfills; and 246-203, General Sanitation, in the Washington Administrative Code (WAC), to protect the public health of the citizens of Snohomish County. These rules and regulations govern solid waste handling, storage, collection, transportation, treatment, utilization, processing, and final disposal of all solid waste within Snohomish County.

B. Purpose. It is expressly the purpose of these rules and regulations to provide for and promote the health of the general public, and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of these rules and regulations.

It is the specific intent of these rules and regulations to place the obligation of complying with its requirements upon waste generators, haulers, operators of handling or disposal sites, and/or property owners. No provision of nor term used in these rules and regulations is intended to impose any duty whatsoever upon Snohomish Health District nor any of its officers or employees.

Nothing contained in these rules and regulations is intended to be nor shall be construed to create or form the basis for any liability on the part of Snohomish Health District or its officers, employees or agents, for any injury or damage resulting from the failure of any person subject to these rules and regulations to comply with these rules and regulations, or by reason or in consequence of any act or omission in connection with the implementation or enforcement of these rules and regulations on the part of Snohomish Health District by its officers, employees, or agents.
